I doubt Megyn Kelly cares personally – the language she used felt like she was trying to guide him to NOT say something so horrifyingly racist that it couldn’t be finessed.

The internment camps *were* found Consitutional by SCOTUS during WWII (Korematsu v. USA) but the court and the US government has roundly rejected the way the constitutional standard was applied in that case (technically as seen here it hasn’t been overturned but that’s mainly because the central question, “is interment base on race legal” hasn’t actually been addressed again.)
So yes, there is precedent, but its BAD precedent and any lawyer saying otherwise should lose their god damn Bar card.
